Comment of Iowa Attorney General Tom Miller
on the U.S. Supreme Court Argument
in the RACI case
Tuesday, April 29, 2003
Comment of Attorney General Miller:
Today I argued that when there is no fundamental right or suspect category involved, the legislature properly has its
broadest authority to act as a fundamental part of the democratic process. This is especially true in economic regulation
matters generally, and in tax cases in particular. The reasons for the differing tax rates are comfortably within the zone
allowed by the Court's prior decisions.
I believe our argument went well and I hope it will be well-received by the Supreme Court. We will know before the Court
recesses in June for the summer.
This was a great experience for me personally. It is almost every lawyer's dream some day to argue before the United
States Supreme Court - and I am extraordinarily grateful to the people of Iowa for giving me this very special opportunity.
