The Attorney General's Office will argue on behalf of Gov. Tom Vilsack that his use of the item veto regarding HF 692 is lawful and within the Governor's constitutional authority.
Under the test prescribed by the Iowa Supreme Court in 1989 in Junkins
v. Branstad, HF 692 meets the definition of an appropriations bill
subject to the Governor's item veto if the measures within the bill allocate
funds in amounts sufficient to significantly affect the Governor's budgeting
responsibility.
The Attorney General supports the Governor's authority to exercise an
item veto of individual items within HF 692.
