New Criminal Charges Filed
in Iowa Film Office Case

Statement of the Attorney General’s Office:

New criminal charges have been filed in the Iowa Film Office case. (The previous preliminary criminal Complaint and Affidavit was filed February 8, 2010 – go to February 8 A.G. Office statement, with links to Complaints.)

The new Complaint and Affidavit was filed last week (June 2) in Polk County District Court. It contains additional charges against defendants named on Feb. 8, including Wendy Weiner Runge and Matthias Alexander Saunders. The new Complaint also contains charges naming Zachary LeBeau, a Minnesota resident and film-maker, according to the affidavit.

LeBeau surrendered to arrest Thursday at the Polk County Jail. He was released on $10,000 bond. There was no change in arrest status for Weiner Runge and Saunders, who are free on bail bond.

The Complaint and Affidavit contains one count of ongoing criminal conduct (a Class B felony), and 11 counts of fraudulent practice in the first degree (a Class C felony) naming Weiner Runge, Saunders, and LeBeau. A Class B felony is punishable by up to 25 years in prison, and a Class C felony is punishable by up to ten years in prison and a fine of $1,000 to $10,000. Also charged in the Preliminary Complaint are Polynation Pictures, LLC; Maximus Production Services, LLC; and The Scientist, LLC.

Prosecutors in the case are Deputy Attorney General Thomas Henry Miller, Assistant Attorney General Denise Timmins, and Assistant Polk County Attorney Justin Allen. The investigation of the case is being handled by the Division of Criminal Investigation of the Iowa Dept. of Public Safety. Investigation continues.

Information contained in the complaints and affidavits are allegations, and defendants are presumed innocent until and unless proven guilty.
