Polk County Judge Sets Court Date for Film Producer
Charged in Iowa Film Tax Credit Case
(DES MOINES, Iowa) Attorney General Tom Miller filed criminal charges against a Beverly Hills, California producer/director who received state film tax credits.
Miller filed trial information documents Friday in Polk County District Court, charging Donald Borchers, 55, with Fraudulent Practice in the First Degree and Theft in the First Degree, both Class C felonies. Today District Judge Douglas Staskal set an arraignment date for November 15.
According to court documents, Miller alleges Borchers submitted inflated cost claims for the film “Children of the Corn,” and accepted state tax credits based on inflated expense claims. Borchers was the film’s producer/director, and owner of post-production vendor Planet Productions, Corp., of Beverly Hills, California.
A criminal charge is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
