State Files Environmental Lawsuit against Northwest Iowa Landfill Agency

Suit alleges illegal waste deposits & environmental safeguards,
no DNR construction permits for two dumping cells

(ORANGE CITY, Iowa) Attorney General Tom Miller today filed a lawsuit against the Northwest Iowa Area Solid Waste Agency (NIASWA) in Sioux County, Iowa, alleging the agency illegally deposited waste into its landfill near Sheldon.

According to the lawsuit, the agency illegally deposited 300,000 tons, or 600,000 cubic yards of solid waste into cells with no liner or a leachate collection system at the Northwest Iowa Area Sanitary Landfill.  Since 2007, state law has required the liner and leachate collection system. 

The suit also alleges that NIASWA began constructing two cells without first obtaining required state permits from the Iowa Department of Natural Resources.

The suit seeks civil penalties and injunctive relief for numerous alleged environmental violations.
