The meeting was called to order at 9:10 a.m.
Art Cox, Director; Bill Greer, Dean; and Keith Saunders, Legal,
from UNI appeared before the Commission to provide funding information
for their real estate program. Discussion also explored various
possibilities of utilizing expertise of the Real Estate Education
Program and other resources at UNI.
Hughes moved, seconded by Miller, to approve the minutes from
the September 28, 2000 meeting. Motion carried unanimously.
Rank made assignments for the Investigation Committee as follows:
Jim Hughes and Evelyn Rank, December 13, 2000; Terry Rogers and
Barb Leestamper, January 25, 2001; Robert Miller and Jim Hughes
March 7, 2001; and Terry Rogers and Evelyn Rank April 11, 2001.
The Commission considered a request for consideration, 543B.15(3),
prior to license application by John Martin. Miller moved; Hughes
seconded to advise Martin that based upon the information provided,
an application for salesperson license at this time would be denied.
Motion carried unanimously.
The Commission considered a request for substitution of experience,
543B.15(8), by Stephen H. Brower. Hughes moved, Miller seconded
to deny. Motion carried unanimously.
The Commission considered a request for waiver or variance of
193E-3.3(2), (4), and (6) by Roland L. Anderson. Miller moved,
Hughes seconded to grant variance to 3.3(2) and (6) to accommodate
for disability by providing a one year extension to complete the
continuing education requirement for renewal and allowing active
status renewal; variance to 3.3(4) to allow all continuing education
to be taken by correspondence was unnecessary at this time. Motion
carried unanimously.
Commission
considered request for waiver or variance 193E-3.3(2) & (4)
by Barbara J. Larson to substitution take all continuing education
by correspondence and to substitute for mandatory courses. Hughes
moved, Miller seconded to deny. Motion carried unanimously.
Miller reported on the ARELLO Annual Conference he attended.
Hughes reported on a questionable advertising practice being used
in his area of the state.
Griebel presented an update on the proposed unlicensed practice
of law rules. The deadline for comments had been extended through
December, 2000, as a result, no action would be taken on the proposal
until next year.
Hansen advised that the first Certificate of Noncompliance had
been filed with the Commission by the Iowa Department of Human
Services. A Notice of Intent to Suspend License will be drafted
and served on the licensee.
Hansen reported that on-line renewals for real estate is now
available. Volunteers were asked to do actual renewals on-line
to test the system. Former commissioner Russ Nading was the first
real estate licensee to renew on-line. Hansen also reported on
the ARELLO Annual Conference he attended. He was elected Central
District Vice-President for 2001. He added that the joint Central
/ Western District Meeting, is scheduled for July 15-17, 2001.
Miller moved, seconded Hughes to adjourn. Motion carried unanimously.
