David Darsee, Investigative Consultant; LuAnn Julstrom, staff.
The meeting was called to order at 9:00 a.m. Jim Hughes, new broker
member of the Commission from Independence, was welcomed to the
Commission.
Randall Minear appeared to request a substitution of experience
so that he could apply for his broker's license per 543B.15(8).
Leestamper moved, seconded by Rogers, to deny the request. Roll
call vote was as follows: Hughes, aye; Rogers, aye; Leestamper,
aye; Miller, aye; Rank, aye. Motion carried unanimously.
Marty Lee and Jennifer McKnight from the IAR appeared for the
discussion of the 70-day delayed administrative rules. Rogers moved,
seconded by Leestamper, to terminate the 4 portions of rules that
were delayed. Motion carried unanimously.
Leestamper moved, seconded by Rogers, to approve the minutes of
the April 13, 2000, meeting.
The investigative committee for Wednesday, June 28, will be Rogers
and Hughes. They will begin at 9:00 a.m.
At 9:30 a.m. a hearing was held in case 99-051. Respondent elected
to have the hearing closed pursuant to Iowa Code 272C.6(1)(1999).
The hearing was tape recorded and a transcript was made by a court
reporter. Administrative Law Judge Randy Stephenson conducted the
hearing.
Hughes moved, seconded by Leestamper, to go into closed session
to deliberate pursuant to Iowa Code 21.5(1)(f). Roll call vote
as follows: Rogers, aye; Hughes, aye; Leestamper, aye; Miller,
aye; Rank, aye. Motion carried unanimously. The discussion was
tape recorded and minutes were taken. The Commission entered into
closed session at 12:08 and arose therefrom at 12:35.
Miller
moved, seconded by Rank, to request that the administrative law
judge draft documents in line with the recommendations of
the Commission. Motion carried unanimously.
Barbara Leestamper left the meeting at 12:35 p.m.
A request for consideration made by Linda Brockway was discussed.
Hughes moved, seconded by Rogers, that the request be denied. Motion
carried unanimously.
Rogers moved, seconded by Miller, to go into closed session pursuant
to Iowa Code 21.5(1)(d)(f). Roll call vote was as follows: Hughes,
aye; Rank, aye; Rogers, aye; Miller, aye. Recommendations of the
investigative committee were reviewed. The Commission entered into
closed session at 12:42 p.m. and arose therefrom at 1:03 p.m.
Motion was made by Rogers and seconded by Hughes to close the
following cases:

Motion carried unanimously.
Motion was made by Miller and seconded by Hughes to accept the
three informal settlements signed by respondents in cases 99-108,
99-076, and 99-077. Motion carried unanimously.
Griebel reported that the June 12 Board Member Orientation should
be valuable for both experienced and new board members.
Hansen reported that he will be attending the ARELLO Central District
meeting July 9-12.
Miller moved, seconded by Rogers to adjourn the meeting. Motion
carried unanimously. Meeting was adjourned at 1:25 p.m.
