The meeting was called to order at 9:05 a.m. Hughes moved, seconded
by Leestamper, to go into closed session pursuant to Iowa Code
21.5(1)(d) and Iowa Code 21.5(1)(f). Roll call vote was as follows:
Rank, aye; Miller, aye; Leestamper, aye; Hughes, aye. Motion carried
unanimously.
The Commission entered into closed session at 9:06 a.m. and arose
therefrom at 10:02 a.m. Miller left the room at 9:25 a.m. while
the Commission discussed cases 00-031, 00-037, and 00-038. Miller
returned at 10:02 a.m.
Recommendations from the investigative committee were discussed.
Leestamper moved, seconded by Miller, to accept the signed informal
settlements in complaint cases 00-017 and 00-072. Motion carried
unanimously.
Hughes moved, seconded by Miller, to close the following closed
cases:

00-093 00-104 00-112 00-116 00-031
00-095 00-105 00-113 00-118 00-037
00-101 00-108 00-114 00-120 00-038

Motion carried unanimously, however Miller abstained from voting
on complaint cases 00-031, 00-037, and 00-038.
Hughes
moved, seconded by Miller to find probable cause in the following
cases: 00-079 00-080 00-094
Motion carried unanimously.
Leestamper moved, seconded by Hughes to accept the minutes of
the August 16, 2000, meeting. Motion carried unanimously.
Future meetings are scheduled as follows:
November 9 Commission Meeting
November 8 investigative committee: Rank, Hughes
December 14 Commission Meeting
December 13 investigative committee: Leestamper, Rogers
The Commission considered a written request by Rhonda Berger to
waive the reinstatement fee for her expired salesperson license.
Motion was made by Hughes and seconded by Leestamper to deny the
request. Motion carried unanimously.
Griebel reported on Iowa Supreme Court Proposed Rules regarding
Unauthorized Practice of Law. She will draft a letter stating the
Commission's concerns regarding ambiguous wording. Griebel left
the meeting at 10:45 a.m.
Hansen reported on the Commission's previous attempts to amendment
543B.7(2) that failed to pass the 1998-1999 and 1999-2000 legislative
sessions. Real estate property management businesses continue to
operate without a real estate license by use of the power of attorney.
The Commission supported resubmission of the proposed amendment
this legislative session.
Rich Nutt, President of the UNI Real Estate Education Advisory
Council; Dr. Art Cox, Director; Bill Greer, Dean of Business Administration
at UNI; and Scott Case, President-Elect of the Iowa Association
of Realtors, appeared before the Commission to present a review
and update of the Real Estate Education Program at UNI.
Griffel advised that the newsletter is in final review. She commented
that accessibility of information on the web and how it has freed
up time taken in the past to send information to the public.
Hansen reported on preparations being made for on-line renewals
with a target deadline of November 1, 2000. He stated that the
ability to access the on-line renewal site would be available from
the Real Estate Commission Home Page. On-line renewal information
will be printed on the renewal application and additionally included
in the mailing. Hansen added that the ARELLO Annual Conference
Meetings are next month and that work continues on Executive Order
8.
Public
comment:
Paul McLaughlin from the IAR mentioned that national meetings would
be held in San Francisco in November.
Motion was made by Hughes and seconded by Miller to adjourn. Motion
carried unanimously. Meeting adjourned at 11:42 a.m.
