MINUTES--October

Present: James Hughes, Vice Chair, Evelyn Rank, Dorothy Woline,
Barbara Leestamper Absent: Robert Miller, Chair
Others
present: Roger Hansen, Executive Secretary; Pam Griebel,
Assistant Attorney General; Susan Griffel, Education Director,
and Tish Young, staff.
The meeting was called to order at 9:10 a.m.
Leestamper moved, second by Rank to go into closed session at
9: 12 a.m. pursuant to Iowa Code 21.5(1)(d) and Iowa Code 21.5(1)(f).
Roll call vote as follows: Hughes, aye; Rank, aye; Woline, aye;
Leestamper, aye. Motion carried unanimously.
The Commission entered into closed session at 9:12 a.m. and arose
there from at 9:45 a.m.
Rank moved, second by Woline to close the following cases: 01-030;
01-012; 01-028, and 01-074. Roll call vote as follows: Hughes,
aye; Rank, aye; Woline, aye; Leestamper. Motion carried unanimously.
Rank moved, second by Woline to find probable cause to file charges
in cases 00-130, 01-031, and 01-034. Roll call vote as follows:
Hughes, aye; Rank, aye; Woline, aye; Leestamper, aye. Motion carried
unanimously.
Leestamper
moved, second by Rank to accept the Informal Settlements in cases
00-070, 00-077, and 00-082. Roll call vote was as follows:
Hughes, aye; Leestamper, aye; Woline, aye; Rank, aye. Motion
carried unanimously.
Rank moved, second by Leestamper to approve the minutes of September
20, 2001 with corrections. Motion carried unanimously.
Future meetings scheduled in 2001 and 2002 were discussed. Hughes
appointed Miller and Hughes to serve on the Investigation Committee
to be held on December 5, 2001.
Rank moved, second by Leestamper to grant a conditional waiver
of 193E-2.11(543B) to William Metropulos, based upon documented
health problems and having missed the six-month examination expiration
by only a few days. The waiver was granted on the condition that
the license must be issued by December 1, 2001. Motion carried
unanimously.
Leestamper moved, second by Rank to deny a request from Mary E.
Schon for a waiver or variance of 193E-3.3(2) the continuing education
required for renewing a broker license. Schon has not exhausted
other options available, including taking the Iowa Broker Examination.
Motion carried unanimously.
Halloran reported that as of November 1, 2001 the Division would
be getting a 4.3% budget reduction. She also stated that the revenue
year to date was 1% less than last year. The Governor has called
a special session of the legislature for November 8th.
Griffel reported that the renewals will be mailed out in the next
couple of weeks. The online renewal education screens have been
changed to reflect the completion of the three year brokerage management
course cycle.
Public comment.
Jim Berry, IAR, suggested that if necessary, the Commission consider
using the Iowa Association of Realtors as a resource to assist
staff perform duties such as complaint investigations, because
of the state's budget problems.
Paul McLaughlin, IAR, reported that a NAR meeting is scheduled
in Chicago next week and the next IAR meeting is scheduled for
December 3-5, 2001 in Des Moines.
Leestamper moved, second by Rank to adjourn the meeting at 10:55
a.m. Motion carried unanimously.
