2001 Meeting Minutes

MINUTES--December 6, 2001

Present: Robert Miller, Chair, James Hughes, Evelyn Rank, Dorothy Woline

Absent: Barbara Leestamper

Others present: Pam Griebel, Assistant Attorney General; Roger Hansen, Executive Secretary; Susan Griffel, Education Director; and Tish Young, staff.

The meeting was called to order at 9:05 a.m.

Hughes moved, second by Rank to go into closed session at 9:05 a.m. pursuant to Iowa Code 21.5(1)(d) and Iowa Code 21.5(1)(f). Roll call vote as follows: Hughes, aye; Rank, aye; Miller, aye; Woline, aye. Motion carried unanimously.

The Commission entered into closed session at 9:05 a.m. and arose therefrom at 9:25 a.m.

Hughes moved, second by Woline, to accept the Informal Settlements in cases 01-044 and 01-031. Roll call vote as follows: Rank, aye; Miller, aye; Hughes, aye; Woline, aye. Motion carried unanimously.

Rank moved, second by Hughes, to close the following cases: 01-022; 01-063; 01-064; 01-069; 01-047; 01-048; 01-058; 01-071; and 01-075. Roll call vote as follows: Rank, aye; Miller, aye; Hughes, aye; Woline, aye. Motion carried unanimously.

Hughes appointed Rank and Woline to the investigation committee for the January meeting.

Rank moved, second by Hughes to approve minutes of October 25, 2001. Motion carried unanimously.

Rank moved, second by Miller to deny a request from Daniel B. Connolly for a waiver or variance from the law relating to the broker prelicense education, salesperson licensing, and examinations. The Commission recommends he be given permission to take the salesperson examination then be required to provide experience to the Commission to substitute for two years of sales experience. Motion carried with all voting aye.

Hughes moved, second by Rank to deny request from Virginia Ray for a waiver or variance from the rules relating to the broker continuing education requirement. Motion carried unanimously.

Miller moved, second by Hughes to grant a waiver of the 18 hour limit of education that may be taken by correspondence and accept all home study courses due to medical conditions. Motion carried unanimously.

Miller reported that he attended a meeting with other board chairs from the Professional Licensing Division, which was held at the Capitol building. He reported that there would be more budget cuts due to less revenue than projected.

Halloran reported that the boards, commissions and licensees must be patient, as we will have a limited staff. We will not be able to provide a three- day turnaround as we have in the past due to losing two staff members.

Halloran reported that there would be more budget cuts in fiscal year 2003 and the Commission needs to be selective as to which types of complaints go to a full hearing. We will continue with informal discussions but will not have money for contract investigators.

Griebel reported that her office has prepared an article for our newsletter concerning the practice of inflating the purchase price for lending purposes that may violate the law.

Griffel reported on changes to Chapter 3 of the administrative rules.

Hansen attended the Iowa Association of Realtors Meeting and provided an update to the Board of Director’s on December 5, 2001.

Public Comment. Paul McLaughlin, IAR, reported that the auctioneer licensing bill might pass the next session of the legislature.

Hughes moved, second by Rank to adjourn the meeting at 11:10 a.m. The motion carried unanimously.
