2001 Meeting Minutes

May 24, 2001--MINUTES

Present: Robert Miller, Chair; Evelyn Rank; Barbara Leestamper; James Hughes; Dorothy Woline.

Others present: Roger Hansen, Executive Secretary; Pam Griebel, Assistant Attorney General; Susan Griffel, Education Director; Carrie Ante, Staff

The meeting was called to order at 9:05 a.m. Dorothy Woline, new broker member of the Commission from Mount Pleasant, was welcomed to the Commission. She has been a licensed real estate broker for over 40 years and has taught prelicense courses for the past 12-13 years.

Miller moved, seconded by Rank to go into closed session pursuant to Iowa Code 21.5 (1)(d) and Iowa Code 21.5 (1)(f). Roll call vote was as follows: Miller, aye; Rank, aye; Leestamper, aye; Hughes, aye; Woline, aye. Motion carried unanimously.

The Commission entered into closed session at 9:08 a.m. and arose there from at 10:39 a.m.

Leestampter moved, seconded by Rank to close the following cases:

Leestamper moved, seconded by Hughes to accept the Informal Settlements in cases 00-079 and 00-149. Motion carried unanimously.

Rank moved, seconded by Miller to reject the Informal Settlement in case 00-153. Motion carried unanimously.

Rank moved, seconded by Hughes to approve the application for salesperson license of Daniel Brown, Jr., only after satisfactory proof of completion of all court ordered programs is provided to the Commission. Motion carried unanimously.

Leestamper moved, seconded by Hughes to approve the minutes of the April 12, 2001, meeting. Motion carried unanimously.

Future meeting dates were discussed. Miller and Rank will serve on the Investigative Committee meeting to be held on Tuesday, June 19, 2001.

Pamela Griebel, Assistant Attorney General, presented a brief overview concerning the duties of a Real Estate Commissioner and other important subjects including the Iowa Gift Law, confidentiality, the sunshine law, and public records.

Griffel encouraged Miller, as chair, and other commissioners to submit articles for the each upcoming newsletter issue.

Ante reported that as a part of her training, she attended the 12 hour salesperson prelicense course “Real Estate License Law and Rules” on April 23 and 24. She added the course was excellent and very beneficial to her.

Hansen distributed copies Senate File 169 containing the commission sponsored change to 543B.7(2) that passed the last session of the legislature and will be effective July 1, 2001. The change limits the exemption to the license mandatory law for persons using a power of attorney to operate a real estate brokerage or property management business without a real estate license. The legislation and replacement sheet are available on the Commission’s web site.

Hansen reported on Executive Order 8 progress and noted that input is continuing to be solicited on eight of the new proposed chapters. All eight new chapters and cross reference are available and easily accessible on the Internet from the Commission’s web site.

Public comment. Paul McLaughlin reported that the next Iowa Association of Realtors meeting is June 5, 6, and 7 in Okoboji. He also briefly discussed the new use of satellite GIS on one or two county assessor’s web sites and the benefits to licensees and the public. He announced upcoming courses, seminars and topics.

Hughes moved, seconded by Leestamper to recess. Motion carried unanimously.

The meeting recessed at 11:55 a.m. and reconvened at 2:00 p.m.

At 2:00 p.m. an open hearing was held in case 00-080. The respondent did not appear. Administrative Law Judge John Priester conducted the hearing. Bill Schroeder was in attendance for the division. At 2:30 p.m. Hansen left the room after testifying.

Leestamper moved, seconded by Hughes to go into closed session to deliberate pursuant to Iowa Code 21.5(1)(f) at 2:34 p.m. Roll call vote was as follows: Miller, aye; Hughes, aye; Leestamper, aye; Woline, aye; Rank, aye. Motion carried unanimously.

The Commission entered into closed session at 2:34 p.m. and arose there from at 2:40 p.m. At 2:40 p.m., Schroeder left the room.

Leestamper moved, seconded by Miller, requested that the administrative law judge draft a proposed Finding of Fact, Conclusions of Law, and Decision and Order reflecting the Commission’s recommendations. Motion carried unanimously.

At 2:41 p.m. Hansen reentered the room.

Hughes moved, seconded by Woline to adjourn the meeting. Motion carried unanimously. Meeting was adjourned at 2:43 p.m.
