Telephone Conference Meeting
Present
via telephone: Chair; Bob Miller, Evelyn Rank, Jim Hughes,
Barbara Leestamper and Dorothy Woline.

The meeting was called to order by Miller at 11:05 a.m.
Hughes moved, seconded by Rank that the Commission enter into
closed session pursuant to Iowa Code section 21.5(1)(d)(f) to review
proposed Final Decisions for Cases 01-060 and 01-034. Roll call
vote as follows: Rank, aye; Leestamper, aye, Hughes, aye, Woline,
aye and Miller, aye. Motion carried. The closed session was tape
recorded and minutes were recorded. The Commission entered into
closed session at 11:08 a.m.
At 11:27 am the Commission returned to Open Session. Hughes moved,
second Rank to approve the draft decision for Case 01-060 Barbara
J. Newquist. Ms. Newquist Real Estate Broker license immediately
REVOKED, she shall pay a civil penalty of $1000, within thirty
days of receipt of this decision. It is further ordered that Ms.
Newquist shall immediately pay the full amount of restitution ordered
by the Polk County District Court. The Respondent shall pay $75,
within thirty days of receipt of this decision for fees associated
with conducting the hearing. The current membership of the Commission
unanimously agrees that the nature of the Respondent's felony theft
conviction disqualifies her from ever holding a Real Estate license
in the state of Iowa. However, if a future Commission considers
reinstatement of her license, it is strongly recommended that the
Respondent be required to repeat all of the education, experience
and examinations required for licensure prior to reinstatement.
Motion carried.
Rank moved, second Leestamper to approve the draft decision for
Case 01-034 Gregory O. Franich. The Commission permanently prohibits
the Respondent from offering his Iowa Real Estate clients reduced
interest rate mortgages conditioned upon the clients using his
services as a Real Estate Broker. The Commission further ordered
Mr. Franich to pay $75, within thirty days of receipt of this decision,
for fees associated with conducting the hearing. Motion carried.
Staff was directed to have the Final Decisions signed by the Commission
Chair and sent to the Respondents as soon as possible.
Leestamper moved, second Rank to adjourn the meeting. Motion carried.
Meeting adjourned at 11:35 am.
