MINUTES--June

Present: James Hughes, Chair, Patty Daniels and Dorothy Woline.
Absent: Barbara Leestamper and Evelyn Rank.
Others
present: Roger Hansen, Executive Secretary, Pam Griebel,
Assistant Attorney General, and Susan Griffel, Education Director.
The meeting was called to order at 9:02 a.m.
Patty Daniels, new salesperson member of the Commission from Des
Moines, was welcomed to the Commission.
Woline moved, second by Daniels to approve minutes of April 18
and April 29, 2002 meetings. Motion carried unanimously.
Hughes appointed himself and Daniels to serve on the Investigation
Committee in July.
The Commission reviewed and discussed the reorganization and clarification
of the present IAC Chapter 193E. Hansen reported that the revision
and re-writing has been a long process covering approximately 2
years to accomplish. Input has been solicited from licensees and
the public throughout the process via the Internet, List serve,
and division newsletter. Hansen noted that Griebel, Paul McLaughlin,
IAR, and Tim Meline, Education Instructor, have been involved from
the beginning and invaluable to the project. Hansen reported the
rules are ready to be approved to file as Notice of Intended Action.
Woline moved, second by Daniels to approve the new proposed 193E
20 chapters to file as Notice of Intended Action. Roll call vote
as follows: Daniels, aye; Woline, aye; and Hughes, aye. Motion
carried unanimously.
The Commission considered and discussed the need to raise fees.
The declining fee income and continued rising costs have resulted
in the need for additional revenues to support the daily functions
of the Commission. The actual license fee had not been raised in
over 25 years. Woline moved, second by Daniels to (1) increase
broker, firm, and salesperson license fees $50 (2) increase all
branch office, additional license, trade name license fees $20,
and (3) assess a $25 fee for certification of a license. Roll call
vote as follows: Daniels, aye; Woline, aye; and Hughes, aye. Motion
carried unanimously.
Hughes reported that he has been invited to speak
at the next Cedar Rapids Board of Realtor’s meeting.
Public Comment.
Jim Berry, former real estate commissioner, commented on funding
and the number of Commission staff employed when he first served
on the Commission, which included two trust account auditors and
two complaint investigators.
Paul McLaughlin, IAR, extended an invitation to attend the next
IAR meeting scheduled for June 10-13, 2002 in Des Moines.
Daniels moved, second by Woline, to go into closed
session pursuant to Iowa Code sections 21.5(a) and 543B.52(1)
to discuss the salesperson
application and Iowa Code sections 21.5(1)(d) and 21.5(1)(f) for
the Investigation Committee’s report and to review and discuss
open complaint cases and an informal settlement signed by the respondent.
Roll call vote as follows: Daniels, aye; Woline; aye; and Hughes,
aye. Motion carried unanimously.
The Commission entered into closed session at 10:48 a.m. and arose
there from at 12:15 p.m.
Daniels moved, second by Woline to grant the salesperson license
application in case 02-039. Motion carried unanimously.
Daniels moved, second by Woline to find probable cause in case
01-091 and to close the following cases: 01-087; 01-088; 02-002,
and 01-084. Roll call vote as follows: Daniels, aye; Woline; aye;
and Hughes, aye. Motion carried unanimously.
Woline moved, second by Daniels to accept the informal settlement
in case number 02-021. Roll call vote as follows: Daniels, aye;
Woline; aye; and Hughes, aye. Motion carried unanimously.
Daniels moved, second by Woline to adjourn the meeting at 12:30
p.m. The motion carried unanimously.
