MINUTES--July
18, 2002
Present: James Hughes, Chair, Evelyn Rank, Barbara Leestamper,
and Dorothy Woline. Patty Daniels joined the meeting at 9:27 a.m.
Others
present: Roger Hansen, Executive Secretary, Pam Griebel,
Assistant Attorney General, and Susan Griffel, Education Director.
The meeting was called to order at 9:09 a.m.
Woline moved, second by Leestamper to approve minutes of June
6, 2002 meeting. Motion carried unanimously.
Hughes appointed himself and Daniels to serve on the Investigation
Committee for August.
The Commission tentatively scheduled a telephone conference meeting
for July 31, 2002 at 10:00 a.m. to adopt the new 193E chapters
currently in the rules making process.
The Commission considered a request by John C. Arnold to substitute
experience for the 24-month active salesperson experience to qualify
for broker. Based upon the information provided, Rank moved, second
by Leestamper to deny the request. Roll call vote as follows: Rank,
aye; Daniels, aye; Woline, nay; Leestamper, aye; and Hughes, aye.
Motion carried.
Hughes
reported that he gave a presentation at the Cedar Rapids Board
of Realtor’s meeting. He added that
the meeting was well attended and the question and answer session
that followed
was interesting.
Woline reported the 60-hour salesperson pre-license course is
now being offered via computer and expressed concern that none
of the 60 hours were live classroom instruction.
Daniels reported she has advised agents that she cannot discuss
confidential pending complaints.
Griffel reported the Instructor Development Workshop would be
held in Des Moines August 21, 2002. The program includes nationally
known presenters.
Hansen reported that he had provided an update on Commission activities
at the Iowa Association of Realtors Board of Directors Meeting
in Des Moines. He also appeared before the Administrative Rules
Review Committee regarding the rules approved by the Commission
June 6, 2002 to file as Notice of Intended Action. The rule making
is progressing favorably. No change in the notice rules is anticipated.
Public Comment.
Paul McLaughlin, IAR, extended an invitation to participate in
the UNI golf outing in Marshalltown. He reported an excellent program
with nationally known speakers is planned for the next IAR meeting
scheduled for September 25, 26, and 27, 2002 in Des Moines. He
additionally reported that committees are looking into possible
legislative issues to address during the next legislative session.
Rank
moved, second by Leestamper, to go into closed session pursuant
to Iowa Code sections 21.5(a) and 543B.52(1)
to discuss the salesperson
application and Iowa Code sections 21.5(1)(d) and 21.5(1)(f) for
the Investigation Committee’s report and to review and discuss
open complaint cases and an informal settlement signed by the respondent.
Roll call vote as follows: Rank, aye; Daniels; aye; and Woline,
aye; Leestamper, aye; and Hughes, aye. Motion carried unanimously.
The Commission entered into closed session at 10:35 a.m. and arose
there from at 11:05 a.m.
Rank moved, second by Leestamper to grant the salesperson license
application in case 02-055. Motion carried unanimously.
Daniels moved, second by Rank to accept the informal settlement
in case number 00-130. Motion carried unanimously.
Rank moved, second by Woline to accept the informal settlement
in case number 02-010. Motion carried unanimously.
Rank moved, second by Leestamper to adjourn the meeting at 11:25
a.m. Motion carried unanimously.
