2002 Meeting Minutes

MINUTES--August 29, 2002

Present: James Hughes, Chair, Evelyn Rank, Dorothy Woline, and Patricia Daniels.
(1 Vacant - Public member)

Others Present: Roger Hansen, Executive Officer, Pam Griebel, Assistant Attorney General, Kay Halloran, Division Administrator, Susan Griffel, Education Director, Tish Young, Staff.

The meeting was called to order at 9:00 a.m.

Rank moved, seconded by Woline to approve minutes of July 18 and August 8, 2002. Motion carried unanimously.

Hughes appointed himself and Daniels to the investigation committee that will meet on October 2, 2002, and Rank and Woline to the committee for November 13, 2002.

Rank moved, seconded by Woline to deny the request from Kim Evans to substitute prior experience to qualify for broker (543B.15(8). Motion carried unanimously.

Rank moved, second by Daniels to go into closed session at 9:10 a.m. pursuant to Iowa Code 21.5(1)(d) and Iowa Code 21.5(1)(f). Roll call vote as follows: Hughes, aye; Rank, aye; Woline, aye; Daniels, aye. Motion carried unanimously.

The Commission entered into closed session at 9:10 a.m. and arose therefrom at 9:38 a.m.

Woline moved, second by Daniels to accept Settlement Agreements in cases 01-051 and 01-091. Motion carried unanimously.

Rank moved, second by Woline to deny the salesperson application of Robert M. Young, case number 02-068. Motion carried unanimously.

Rank moved, second by Woline to deny the salesperson application of Lonson J. Luloff, case number 02-057. Motion carried unanimously.

Rank moved, second by Woline to find probable cause in case 02-022. Motion carried unanimously.

Daniels moved, second by Rank to reconvene in closed session at 9:50 a.m. pursuant to Iowa Code 21.5(1)(d) and Iowa Code 21.5(1)(f). Roll call vote as follows: Hughes, aye; Rank, aye; Woline, aye; Daniels, aye. Motion carried unanimously.

The Commission reconvened in closed session at 9:50 a.m. and arose therefrom at 10:00 a.m.

Daniels moved, second by Rank to close cases 02-033 and 02-034. Motion carried unanimously.

Hansen reported that the new rules will become effective on October 9, 2002.

Hansen stressed the importance of on-line renewals inasmuch as the process allows staff more time to attend to other office matters.

Hansen also reported that the Governor's office is working on appointing a new commissioner to replace Leestamper who resigned.

Halloran reported that the Revenue Estimating Conference will meet on September 6, 2002.

Griebel requested that the commission members refer all requests for public records to Hansen. This includes all emails and correspondence.

Griffel reported on the recent Instructors Workshop which had over 47 people in attendance. Deb Long presented a refresher course in Ethics requirements.

Public comment. Jim Berry, reporting for Paul McLaughlin, IAR, extended an invitation to attend the Iowa Association of Realtors meeting September 24-27, 2002 in Des Moines. The program includes nationally recognized presenters. He also reported renewed interest in pursuing Title Insurance legislation during the next legislative session.

Rank moved, Woline second to adjourn the meeting. The meeting adjourned at 10:25 a.m.
