MINUTES--April
17, 2003
Present: James Hughes, Chair, Evelyn Rank, Vice Chair,
James O'Neill, Patty Daniels, and Dorothy Woline.
Others
Present: Roger Hansen, Executive Officer and Susan Griffel,
Education Director, and Kay Halloran, Division Administrator.
The meeting was called to order at 9:05 a.m.
Hansen presented Rank with a plaque on behalf of the Professional
Licensing Division for her service on the Commission.
Hughes, Daniels, O'Neill, Woline, Griffel, and Halloran joined
in recognizing Rank.
Marty Lee, IAR, Paul McLaughlin, IAR, and Jim Berry, IAR were
present and also joined in recognizing Rank.
Hughes granted a request to go out of order on the agenda to accommodate
public comment.
Jim Berry, IAR, commented on unlicensed real estate activities
and the need for civil penalties for violations.
Ray Osthus, Broker, commented on unlicensed real estate activities
and presented the Commission with copies of documents containing
three examples of alleged violations of the license mandatory provisions
of the law.
Marty Lee, IAR, commented on Virtual Office Websites and noted
that for the past 2 years NAR has not been able to obtain agreement
on proposed guidelines.
Hughes asked Lee about amendments to HF 655 which if passed would
greatly affect the Commission's budget. Lee indicated he was aware
of the amendments, but after the fact, as the IAR did not initiate
the amendments and the IAR lobbyist was not promoting the amendments.
Lee offered to assist in resolving issues.
Paul McLaughlin, IAR, provided an update on the association's
legislative activities and extended an invitation to attend the
next IAR meeting June 10, 11, and 12, 2003.
Rank moved, second by O'Neil to go into closed session pursuant
to Iowa Code 21.5(1)(d) and 21.5(1)(f). Roll call vote as follows:
Rank, aye; Daniels, aye; O'Neill, aye; Woline, aye; and Hughes,
aye. Motion carried unanimously.
The Commission entered into closed session at 9:50 a.m. and arose
therefrom at 11:52 a.m.
Rank moved, second by Daniels to deny the sales application in
case
No. 03-024. Motion carried unanimously.
The Commission directed staff to respond to the request for consideration
prior to application in case No. 03-045.
O'Neill moved, second by Rank to accept the signed Informal Settlements
in complaint cases 02-038, 02-026, 02-101, and 02-107. Motion carried
unanimously
Rank moved, second by Woline to find probable cause in complaint
cases
02-095, 02-058, 03-003, and 02-078. Motion carried unanimously.
Daniels moved, second by Rank to close the following complaint
cases:
02-106, 03-020, 03-028, 02-019, 03-007, 02-017, 03-030, 03-021,
03-022, and 02-013. Motion carried unanimously.
The tentative meeting schedule was reviewed. Hughes appointed
O'Neill and Woline to serve on the Investigation Committee May
28, 2003.
Woline reported that she has been invited to speak at the Mt.
Pleasant Board of Realtors Meeting.
Hughes reported that he represented the Commission at the UNI
Real Estate Education Advisory Meeting at the University of Northern
Iowa.
Halloran reported that Laurie Dawley, Walford, Iowa had been appointed
to the Commission as a new public member.
Hansen reported on attending the ARELLO (Association of Real Estate
License Law Officials) midyear meeting. He also reported that a
letter of interest had been delivered to Rice Insurance Services
and Williams Underwriting Group to determine provider interest
in bidding on the Iowa Real Estate Commission Group Errors and
Omissions Insurance Program.
O'Neill nominated Hughes to serve as Chair of the Commission,
second by Woline. Carried unanimously.
Daniels nominated Woline to serve as Vice Chair of the Commission,
second by O'Neill. Carried unanimously.
Rank moved, second by Daniels to adjourn the meeting. Motion carried
unanimously.
