The meeting was called to order at 9:00 a.m.
Woline moved, seconded by O'Neill, to go into closed session pursuant
to Iowa Code 21.5(1)(d) and 21.5(1)(f) to discuss application for
re-hearing and petition for stay on Case 02-025. Roll call vote
was as follows: Woline, aye; Daniels, aye; O'Neill, aye; Hughes,
aye. Motion carried unanimously. The Commission entered into closed
session at 9:01 a.m. and arose therefrom at 9:11 a.m. Hansen and
Griebel excused themselves from the closed session.
O'Neill moved, seconded by Woline to deny the application for
re-hearing and the petition for stay on Case 02-025. Motion carried
unanimously.
Hansen and Griebel returned to the meeting.
O'Neill moved, seconded by Daniels to go into closed session pursuant
to Iowa Code Sections 21.5(1)(a), 21.5(1)(d), 21.5(1)(f) 543B.52(1)
for the purpose of discussing open cases. Roll call vote was as
follows: Woline, aye; Daniels, aye; O'Neill, aye; Hughes, aye.
Motion carried unanimously. The Commission entered into closed
session at 9:16 a.m. and arose therefrom at 9:45 a.m.
O'Neill moved, seconded by Woline to deny salesperson application
without prejudice in Case 03-46. Motion carried unanimously.
Daniels moved, seconded by O'Neill to accept informal settlement
on Case 02-011. Woline abstained from voting. Motion carried unanimously.
Daniels moved, seconded by O'Neill to approve the July 17, 2003
minutes. Motion carried unanimously.
Future
meetings are scheduled as follows:
October 1 investigative committee: Hughes, Daniels
October 2 Commission Meeting
The Commission considered requests for waivers from Donald McKibben
and Michael McKibben asking for an extension on the expiration
of exam scores and exemption from errors and omission insurance
requirement with original application. O'Neill moved, seconded
by Woline to deny the waiver requests. Motion carried unanimously.
Griebel reported on the Franich appeal. The final brief has been
filed.
Griffel reported on her attendance at the Instructor Development
Workshop. It was very informative.
Griffel reported the Division Newsletter would be once again utilized.
The next edition will be mailed out September 24, 2003.
Hansen reported that the Division is moving forward with hiring
an auditor. The new rules for decreasing fees are scheduled to
be adopted on September 11, 2003.
Paul McLaughlin from the IAR reported on the 2003 Convention.
The IAR continues working on consolidating local boards.
Motion was made by Daniels and seconded by Woline to adjourn.
Motion carried unanimously. Meeting adjourned at 11:30 a.m.
