MINUTES

Present via Telephone because it was not practical to personally
attend due to inclement weather: Laurie Dawley, Vice-Chair; Lori Diehl

The meeting was called to order at 9:07 a.m. by Chair Hughes.
MINUTES
Motion made by Berry, seconded by O’Neill, to approve the December
13, 2007 minutes. Motion carried unanimously.

COMMISSIONER REPORTS
O’Neill reported he attended the ARELLO meeting and it was business
as usual.
STAFF REPORTS
Klisares reported on line renewal was successful with 83% of renewals
done online this year as compared to 28% last year.
Malek reported that 499 continuing education audits were done in 2007
and 12 were not in compliance. She also reported 56 firms and 294
individuals were audited in 2007 for E&O Insurance and of those, 10
firms and 46 individuals were not compliant.
Batts handed out a chart reviewing the statistics for the last three
years showing an increase in complaints each year.
Hansen reported that the Commission’s E&O Insurance Program would go
out for bid this year.
PUBLIC COMMENT
McLaughlin reported the IAR legislative Bus-in Day scheduled in
February. He also reported on IAR legislative committee issues to be
pursued in 2008: the water lien bill, changes to 543B.15(3a), and a
repeat offender bill.
CLOSED SESSION
Motion made by Dawley, seconded by O’Neill, to enter into closed
session pursuant to Iowa Code 21.5(1)(d) and 21.5(1)(f) to discuss
informal settlements, consent agreements/orders or Consent Orders. Roll
call as follows: Hughes, aye; Dawley, aye; Diehl, aye; O’Neill, aye and
Berry, aye. Motion carried unanimously.
The Commission entered into closed session at 9:29 a.m. and arose
therefrom at
10:37 a.m.
OPEN SESSION
Motion made by Dawley, second by O’Neill to accept signed settlements
and/or consent agreements, cease and desist or consent order for cases:

Motion made by Berry, second by O’Neill to find probable cause on the

08-004; A08-001 and 07-024. Motion carried unanimously.
Motion made by Hughes, second by Berry to close the following cases:

07-273; 07-292; 07-283; 07-288; 07-301; 07-303; 07-236; 07-259; 07-109;
07-130 and 07-190. Motion carried unanimously.
Motion made by O’Neill, seconded by Berry to deny the application for
salesperson license in case 07-249. Motion carried unanimously.
Motion made by Dawley, seconded by Diehl to grant an extension for
payment on case 07-232. Motion carried unanimously.
Motion made by Berry, seconded by Diehl to grant this request and
allow the two companies to license the same trade name. Motion carried
unanimously.
MEETING ADJOURNED
Motion made by Berry, seconded by O’Neill, to adjourn. Motion carried
unanimously. Meeting adjourned at 10:45 a.m.
