Rules Docket

The Rules Docket lists all rule changes currently in process for the Iowa Department on Aging, from the time notice of the proposed rule is submitted to the Governor's Office through the month when the rule change takes effect.  The rule changes are sorted by their targeted effective date. 

You can access the text of the rule change by clicking on the ARC number link below.  Most rule changes will have two ARC numbers because they are published twice:  Once as a Notice of Intended Action and again when the rule is Adopted and Filed. If there is only one ARC number link for rules listed as Adopted, it is because a rule change was Adopted and Filed Emergency without Noitce.

You may comment on a noticed rule until the date specified in the notice, which is listed below as the public comment period. You can access summaries of comments received and the Department's responses by clicking on the Comment link below. If there is no Comments link available, no comments were received during the public comment period.

Chapter 5, Department Fiscal Policy, ARC9577B and ARC9576B. These amendments address the elimination of the senior living trust program funding and implement the provisions of pending appropriations legislation. The amendments establish an equitable funding formula that continues to give priority to older Iowans who are aged 75 and older, reside in rural areas, are racial minorities, and have an income level at or below the official poverty guidelines.

Chapter 8, Long-Term Care Resident's Advocate/Ombudsman,
ARC 9227B (11/17/10) ARC 9349B (2/9/11) Provides procedures for volunteer access to facility records and also clarifies that a civil penalty of not more than $1,500 may be imposed for interference with the duties of the state or a local long-term care resident's advocate/ombudsman.

Chapter 8, Long-Term Care Resident's Advocate/Ombudsman,
ARC 8772B (5/19/10), ARC 8939B (7/14/10) Updates the chapter's purpose; removes unnecessary definitions and adds new ones, removes rules on duties for the long-term care resident's advocate/ombudsman, access requirements, and department responsibilities for confidentiality, complaint referral, and federal law; and establishes procedures for notice and appeal of penalties imposed for interference with the official duties of a long-term care resident's advocate/ombudsman.

Chapter 15, Elder Abuse Prevention and Awareness and Mandatory Reporter Training: ARC 8553B (2/24/10), ARC 8427B (12/30/09) Provides for the enhanced prevention, detection, and reporting of elder abuse, local advocacy, and service coordination for the protection of older individuals and establishes criteria or certifying trainers of dependent adult abuse mandatory reporter training. Contains provisions currently found in Chapter 12.

Chapters 24, 25, 26, 27, 29, Assisted Living Programs, Adult Day Services, and Elder Group Homes: ARC 8420B (12/30/09) Rescinds administrative rules for assisted living programs, adult day services, and elder group homes to comply with 2007 Iowa Acts, SF 601, which transferred regulatory authority for these to the Department of Inspections and Appeals (DIA). The DIA filed adopted rules for regulation of the same that will be effective January 1, 2010.

Chapter 14, Iowa Family Caregiver Support Program: ARC 7599B (2/25/09), ARC 7456B (12/31/08) Provides support services for family caregivers of persons age 60 and over and for grandparents or older individuals who are relative caregivers of children. Chapter 22, Substitute Decision Maker: ARC 7445B (12/31/08), ARC 7133B (9/10/08) Implements the Office of Substitute Decision Maker and establishes standards and procedures for those appointed as substitute decision makers. Also, establishes the qualifications of consumers eligible for services.
