WAIVER OR VARIANCE FROM BOARD RULES
The Board may grant a waiver of or variance from all or part of a rule. No waiver or variance may be granted from a requirement that is imposed by statute. Any waiver or variance must be consistent with state and federal statutes. The procedures for waiver or variance of Board rules are found in 657—Chapter 34.
The decision on whether the circumstances identified in the petition justify the granting of a waiver or variance shall be made at the discretion of the Board upon consideration of all relevant factors. The petitioner shall assume the burden of persuasion when a petition is filed for waiver or variance from a Board rule. A petition for waiver or variance shall be submitted in writing to the Board. The petition for waiver/variance form is available in Word format for completion and mailing to the Board office.
LIMITED USE PHARMACY LICENSE
Limited use pharmacy license may be issued for pharmacy practice settings including, but not limited to, nuclear pharmacy practice, correctional facility pharmacy practice, or veterinary pharmacy practice. A written request for exemption from certain licensure requirements will be determined on a case-by-case basis.
PHARMACY LICENSE WITH EXEMPTION
Applicants for pharmacy license shall comply with board rules regarding the specific type of pharmacy practice setting, including universally applicable standards, except where specific exemptions have been granted pursuant to the procedures and requirements of 657—Chapter 34. Applicants who are granted exemptions shall be issued a "general pharmacy license with exemption," a "hospital pharmacy license with exemption," a "nonresident pharmacy license with exemption," or a "limited use pharmacy license with exemption" and shall comply with the provisions set forth by that exemption.
