The following rules were approved during the April 24, 2013, meeting of the Board of Pharmacy.

Chapter 10, “Controlled Substances,” Chapter 22, “Unit Dose, Alternative Packaging, and Emergency Boxes,” and Chapter 23, “Long-Term Care Pharmacy Practice." The amendments authorize a pharmacy other than a facility’s primary provider pharmacy to provide to the facility to meet the needs of the facility’s patients an emergency/first dose drug supply containing those drugs and products not stocked or available from the primary provider pharmacy. This additional supply may include, but is not limited to, parenteral or compounded drug products. The amendments also provide that a multidose container of a drug removed from the emergency drug supply for administration to a patient be labeled with a patient-specific label within 24 hours of initial administration or that an appropriately labeled drug order be dispensed and delivered by the provider pharmacy. The record requirements for controlled substances destroyed in a long-term care facility and for previously dispensed controlled substances destroyed by a pharmacy are amended to require the recording of the dispensing pharmacy or other source of the controlled substance and the prescription number or other unique identification assigned to the prescription.

The folowing rules were approved during the November 9, 2012, meeting of the Board of Pharmacy:

Chapter 2, “Pharmacist Licenses,” Chapter 3, “Pharmacy Technicians,” Chapter 5, “Pharmacy Support Persons,” Chapter 8, “Universal Practice Standards,” Chapter 10, “Controlled Substances,” Chapter 12, “Precursor Substances,” Chapter 17, “Wholesale Drug Licenses,” Chapter 24, “Pharmacy Internet Sites,” and Chapter 30, “Impaired Pharmacy Professional and Technician Recovery Program.” The amendments reduce by at least 10 percent most initial and renewal license and registration fees and most penalty fees for late applications that are currently assessed by the Board. After the 10 percent reduction is calculated, some of the fees are rounded down to the next lowest $10 increment to simplify accounting. Additional amendments clarify the forms of payment currently accepted by the Board and provide that a late payment penalty fee is not to be imposed on an application for renewal of a delinquent pharmacy technician registration if the applicant has not been practicing as a pharmacy technician since the registration expired. The amendments also eliminate the surcharge that has been imposed on pharmacist, pharmacist-intern, and pharmacy technician license and registration fees. The surcharge funds the Impaired Pharmacy Professional and Technician Recovery Program (IPRN). The Board has determined that at this time the surcharge is an unnecessary cost and burden to these individuals and that the Board will support the IPRN from retained fees. These amendments will become effective on January 16, 2013.
Chapter 6, "General Pharmacy Practice." The amendment clarifies that the pharmacist in charge of a general pharmacy is responsible for establishing, implementing, and periodically reviewing and revising written policies and procedures for the operations of the pharmacy and is also responsible for ensuring that all pharmacy personnel are familiar with the pharmacy's established policies and procedures. This amendment will become effective on January 16, 2013.
Chapter 7, "Hospital Pharmacy Practice." The amendments authorize a hospital pharmacy to contract for remote order entry and medication order preview and verification with another licensed pharmacy to supplement hospital pharmacy services and to increase the availability of the pharmacist for involvement in cognitive and patient care activities. These amendments will become effective on January 16, 2013.
Chapter 8, "Universal Practice Standards." The amendment clarifies the requirement for prior notification to the Board when a pharmacy plans to remodel or relocate a pharmacy department, establishing that the notification be submitted to the Board at least 30 days prior to commencement of the project. The amendment also clarifies that the Board may require inspection of the proposed remodel or relocation site, including inspection of a temporary pharmacy location, inspection of a barrier constructed or intended to be constructed to provide security when the pharmacy department is closed, and inspection of a proposed installation of sterile compounding facilities and equipment. The amendment combines two subrules that address requirements for light, ventilation, temperature, and humidity into a single subrule and renumbers two subrules as a result of the rearrangement and the addition of a new subrule. This amendment will become effective on January 16, 2013.

A pharmacy may honor an original manufacturer’s discount coupon presented by a patient for the purchase of a controlled substance, including a pseudoephedrine-containing product. A pharmacy may not discount a controlled substance upon presentation of a copy of a manufacturer’s discount coupon for the product. A pharmacy may not offer or honor a discount coupon published or provided by the pharmacy or the pharmacy’s corporation. The following amendments were approved for filing and adoption during the August 29, 2012, meeting of the Iowa Board of Pharmacy.

Chapter 6, "General Pharmacy Practice." The amendment authorizes a pharmacist or pharmacist-intern, upon the request of a patient, to transfer one or more prescriptions to the pharmacy of the patient's choice. A transfer must be initiated by direct communication between a pharmacist or pharmacist-intern at the transferring pharmacy and a pharmacist or pharmacist-intern at the receiving pharmacy. Following direct communication between authorized individuals, the transfer of prescription information may be accomplished by facsimile transmission in compliance with the record requirements of rule 657--6.9(124,155A). This amendment will become effective on November 7, 2012.
Chapter 11, "Drugs in Emergency Medical Services Programs." The amendments exclude nonmedicated intravenous solutions from the definition of “drug” as that term is used within the chapter and specify that records that are required to be maintained by or within an emergency medical services program under this chapter are to be maintained and made available for inspection and copying by the board, the board’s representative, or other authorized individual. The amendments provide that the monthly inspection of drug supplies maintained at the primary emergency medical services program site may be inspected by a pharmacist, pharmacist-intern, certified pharmacy technician, or the service director if the program is a pharmacy-based service or by the medical director, service director, or other designated EMS personnel if the program is a medical director-based program. The amendments also clarify the content and format of the required record following the administration of a controlled substance. These amendments will become effective on November 7, 2012.

The following amendments were approved for filing and adoption during the June 27, 2012, meeting of the Iowa Board of Pharmacy.

Chapter 7, "Hospital Pharmacy Practice." The amendment provides that a medication order for administration of a Schedule II controlled substance in a hospital outpatient setting may authorize the administration of an appropriate amount of the substance within 90 days of the date the medication administration order is initially authorized by the prescriber. This amendment will become effective on September 12, 2012.
Chapter 24, Pharmacy Internet Sites," and Chapter 37, "Iowa Prescription Monitoring Program." The amendments change the definition of "dispenser" to include nonresident pharmacies that dispense prescriptions for controlled substances in Schedules II through IV of Iowa Code chapter 124; amend the requirement for reporting of those substances, contained in Chapter 24 regarding pharmacy Internet sites, to ensure that all pharmacies dispensing Schedules II through IV controlled substances to patients located in Iowa understand the requirement for reporting those prescriptions to the Iowa Prescription Monitoring Program (PMP); identify those pharmacies that may be exempt from reporting to the Iowa PMP and establish processes for claiming such exemption; and change prescription reporting frequency from twice monthly to weekly reporting and establish a timely reporting deadline. These amendments will become effective on January 1, 2013.

Continuing Education

The Iowa Board of Pharmacy requires 30 contact hours (3.0 CEU) of pharmacist continuing education for every two-year renewal. New pharmacists obtaining license by examination or score transfer in Iowa shall be exempt from continuing education requirements for their first license renewal.

Continuing education (CE) activities that carry the seal of the Accreditation Council for Pharmacy Education (ACPE) accredited provider will automatically qualify for Iowa pharmacist CE credit. At least 15 contact hours of the required 30 hours of pharmacist CE shall be in ACPE-accredited activities dealing with drug therapy topics including, but not limited to: adverse drug reactions, biotechnology, clinical monitoring and drug utilization review, disease state, drug delivery systems, drug information, drug interactions, drug product selection, drugs, medical compliance, new drugs, nuclear pharmacy, OTC therapeutics, pharmacology, pharmacokinetics, substance abuse, and general therapeutics. The last two digits of the universal activity number will be 01 or 02.

ACPE-accreditd activity numbers with the letter L refer to live courses, H refers to home study or other mediated courses, and C refers to courses combining live and home study or mediated components. The final two numeric characters in the activity number identify the primary program topics: 01 = drug therapy/disease state management, 02 = AIDS therapy; 03 = law (related to pharmacy practice), 04 = general pharmacy, and 05 = patient safety.ACPE-accredited activity numbers ending in 01 or 02 qualify for drug therapy. A final character "P" designates the target audience is licensed pharmacists and a final character "T" indicates the activity is intended for pharmacy technicians. A pharmacist may use only pharmacist (P) courses to fulfill the continuing education requirements.

Pharmacists are also required to obtain two contact hours of CE in pharmacy law. Law CE must be from ACPE-accredited provider activities. The universal activity number for a pharmacy law activity will end in 03.

Two contact hours of CE dealing with patient or medication safety are also required for pharmacist license renewal. These hours may be obtained from ACPE-accredited providers (universal activity numbers ending in 05) or from non-ACPE provider activities pursuant to subrule 2.12(1), paragraph (a).

Remaining CE hours may be obtained through completion of activities provided by an accredited CME or other health professions provider if the activity content directly relates to the pharmacist's professional practice. CE offered by a non-accredited provider will not be accepted toward fulfilling pharmacist CE requirements.

Pharmacists shall retain in their personal files for a minimum of four years all activity certificates. The final three characters in the ACPE course number identify the program topic and type of course.

A pharmacist currently enrolled in health-related graduate studies may apply for exemption from continuing education requirements during the period of that enrollment. Application forms are available from the Board office. Exemption may be prorated based on the period of enrollment and the license renewal period. Applications for exemption from CE requirements should be completed as soon as possible following enrollment in the graduate program. Applications for exemption submitted with license renewal applications may delay the renewal processes beyond license expiration. For more information and forms, see Exemption Application.

A new rule requires pharmacists to obtain two hours of CE in pharmacy law and two hours of CE in medication/patient safety. Here is how you can identify these credits:

ACPE course identifiers in pharmacy law for pharmacists will end with "03P."
ACPE course identifiers in medication/patient safety for pharmacists will end with "05P."

Pharmacy Internet Site Registration

An Internet site that intends to display, advertise, or solicit the Internet sale of prescription products to patients in Iowa must obtain and maintain a Pharmacy Internet Site Registration from the Iowa Board of Pharmacy. A Pharmacy Internet Site Registration is issued to the Internet site by the domain name and the owner of the Internet site.

657 Iowa Administrative Code Chapter 24 establishes the requirements for the Internet sale of prescription products by pharmacies. The Chapter also establishes requirements for VIPPS accreditation of Internet pharmacies and defines terms such as “Internet pharmacy,” “VIPPS accreditation,” “Internet sale,” and “prescription product.”

An Internet pharmacy that provides any prescription drug to any patient located within Iowa must obtain and maintain an Iowa pharmacy or nonresident pharmacy license. The pharmacy must also obtain and maintain VIPPS accreditation and evidence of VIPPS accreditation must be provided on any Internet site identifying the Internet pharmacy.

The following information must be displayed either on the home page of the Pharmacy Internet Site or a clearly and conspicuously identified link to this information must be visible and available on the Pharmacy Internet Site’s home page.

A statement consisting of language substantially equivalent to “In compliance with Iowa Code section 155A.13B and 657 IAC Chapter 24, this Internet Site is registered with the Iowa Board of pharmacy, registration number____,” including the registration number issued to the pharmacy Internet site by the Board.
For each pharmacy that delivers, distributes, or dispenses prescription products pursuant to orders made on, through, or on behalf of the pharmacy Internet site: the name of the pharmacy; the address of the licensed physical location of the pharmacy; the telephone number of the pharmacy; and the pharmacy license number issued to the pharmacy by the Iowa Board of Pharmacy.
The VIPPS or Vet-VIPPS seal (the symbol provided by NABP to a pharmacy for display on the pharmacy’s Internet site evidencing the pharmacy’s VIPPS or Vet-VIPPS accreditation). The site must also maintain a link to NABP’s accreditation verification site and a link to the NABP certification that identifies the individual Internet pharmacy as a VIPPS or Vet-VIPPS accredited site.

The requirements for registration of a Pharmacy Internet Site are effective May 1, 2012. A previously operating Pharmacy Internet Site must file an application for registration of the site no later than May 1, 2012. A new Pharmacy Internet Site must apply for registration of the site no less than 30 days prior to implementation of the Pharmacy Internet Site.

The following amendments were approved for filing and adoption during the January 19, 2012, meeting of the Iowa Board of Pharmacy and the Prescription Monitoring Program Advisory Council by electronic communications between January 18, 2012, and January 20, 2012. The amendments will become effective July 1, 2012:

Chapter 37, "Iowa Prescription Monitoring Program. The amendments define "health care professional" and "practitioner's agent" and establish criteria for the identification, authorization, and registration of a practitioner's agent to request information from the Iowa Prescription Monitoring Program (PMP). The amendments clarify circumstances that may require the PMP administrator to access program information and data to resolve issues of potentially erroneous data contained in the database. The amendments regarding prohibited acts and confidentiality requirements of the current rules ensure applicability of those provisions to a practitioner’s agent and ensure that all individuals with access to the PMP and PMP data are aware of the criminal penalties for breach of confidentiality provisions and prohibited acts.

The Iowa Pharmacy Association and the Iowa Department of Public Health, Office of Health IT, have put together Iowa E-health FAQs regarding electronic prescribing of controlled substances. At this time, there are no prescribing systems or pharmacy systems that have been certified to transmit or receive electronic prescriptions for controlled substances. The FAQs provide information regarding the requirements for a system to be certified for electronic prescribing of controlled substances and includes links to additional information regarding electronic prescribing. Do we need to be licensed to ship prescription devices to end users in Iowa?

There is currently no license required for the distribution of prescription medical devices directly to patients pursuant to the order of a qualified prescriber. This includes medical gases and oxygen.

The distribution of prescription medical devices, including medical gases and oxygen, at wholesale to pharmacies, hospitals, prescribers, etc. in Iowa requires a wholesale drug license. The license application form is available on the Board of Pharmacy’s web site at http://www.state.ia.us/ibpe/application forms.html.

Effective January 12, 2012, all drug products containing carisoprodol will be classified as Schedule IV controlled substances, subject to the record-keeping, prescribing, and security requirements of the Controlled Substances Acts for Schedule IV substances. Any pharmacy, prescriber, manufacturer, distributor, or other entity in possession of any quantity of carisoprodol on January 11, 2012, must complete an initial inventory of that supply on or before January 11, 2012. Anyone within Iowa who is in possession of carisoprodol on January 12, 2012, (except a patient who possesses the drug pursuant to a valid prescription) must be registered with the federal Drug Enforcement Administration and the Iowa Board of Pharmacy to possess Schedule IV controlled substances.

The following rules were approved for filing and adoption during the November 10, 2011, meeting of the Iowa Board of Pharmacy and will become effective January 18, 2012:

Chapter 6, "General Pharmacy Practice." The amendment clarifies the required placement of a notice informing patients that the pharmacist is required to discuss with the patient any new prescriptions dispensed to the patient. The amendment also defines the instances when patient counseling is required.
Chapter 7, "Hospital Pharmacy Practice." The amendments clarify the definition of a hospital pharmacy to which the chapter applies and clarify the processes and security requirements for a verbal order for the administration of a prescription drug to a patient in a hospital. The proposed amendments also organize subrule 7.8(3) into distinct paragraphs and identify the subject of each of the paragraphs with catchwords.
Chapter 8, "Universal Practice Standards," Chapter 10, "Controlled Substances," Chapter 21, "Electronic Data in Pharmacy Practice," and Chapter 23, "Long Term Care Pharmacy Practice." The amendments clarify the required elements of a valid prescription regardless of the method used to generate or prepare the prescription or the means of transmission or delivery of the prescription to the dispensing pharmacy. The amendments identify the requirements for a written prescription, for an oral prescription, for a prescription transmitted to a pharmacy via facsimile, and for a prescription that is electronically prepared, signed, and transmitted to the pharmacy. Additional requirements are identified for prescriptions that are electronically prepared but subsequently printed or transmitted to the pharmacy via facsimile, and a clear distinction is made between “electronic transmission” and “facsimile transmission” by defining those terms. Other new and amended definitions in Chapter 21 establish the difference between an “electronically prepared prescription” and an “electronic prescription” and clarify the definition of “electronic signature.” The requirements for electronic prescribing of controlled substances, as established by the federal Drug Enforcement Administration (DEA), are addressed, and appropriate amendments are proposed to authorize the electronic prescribing of controlled substances pursuant to DEA requirements. Record-keeping requirements for electronically prepared prescriptions, electronic prescriptions, and prescriptions transmitted via facsimile are identified. The requirements for identification of the prescriber’s agent who completes the transmission of a prescription to a pharmacy are clarified to include the first and last names and the title of the prescriber’s agent.

The following rule was approved filing and adoption during the November 10, 2011, meeting of the Iowa Board of Pharmacy and will become effective February 1, 2012

New Chapter 24, “Pharmacy Internet Sites." The rules establish the requirements for the Internet sale of prescriptions by pharmacies and for accreditation by the National Association of Boards of Pharmacy (NABP) as a verified Internet pharmacy practice site (VIPPS). The proposed rules identify specific information that must be displayed on a pharmacy Internet site and establish requirements for site registration with the Board. Terms used in the chapter are defined, prescription requirements are identified and responsibilities established, and record-keeping requirements are established. The proposed rules also establish grounds for denial of an application for pharmacy Internet site registration or registration renewal and for disciplinary action and identify appeal processes and sanctions relating to those actions.

Chapter 2, "Pharmacist Licenses." The amendments require that a pharmacist complete no less than two continuing education units (CEUs) in activities dealing with patient or medication safety and that a pharmacist complete no less than two CEUs in activities dealing with pharmacy law.
Chapter 3, "Pharmacy Technicians," and adopt new Chapter 40, "Tech-Check-Tech Programs." The amendments authorize the establishment of a tech-check-tech program in a hospital pharmacy or in a general pharmacy only for dispensing to patients in a residential care facility.
Chapter 4, "Pharmacist-Interns." The amendments add a new subrule that identifies the information required to be provided in or with the application for registration as a pharmacist-intern, renumbers subsequent subrules, and corrects a reference in the definition of “nontraditional internship booklet” to a renumbered subrule.
Chapter 5, "Pharmacy Support Persons." The amendments clarify the authority of a pharmacy support person, under the supervision of a pharmacist, to place a prescription container that has been verified by a pharmacist into a bag or sack for delivery to the patient as part of the sales transaction.
Chapter 11, "Drugs in Emergency Medical Service Programs." The rules define terms used throughout the chapter and establish responsibilities for parties involved in the provision of drugs to emergency medical service (EMS) programs.

The following rule was approved for emergency filing and adoption during the August 10, 2011, meeting of the Iowa Board of Pharmacy and became effective August 11, 2011.

Chapter 8, "Universal Practice Standards." The amendment relates to the responsibilities of the pharmacies when a pharmacy closes. Those responsibilities include notifications by the closing pharmacy to the Board and the federal Drug Enforcement Administration (DEA) at least 30 days prior to the pharmacy closing and the content of those notifications; notifications to the pharmacist in charge of the closing pharmacy at least 40 days prior to the pharmacy closing and including the pharmacist in charge in the notification and closing processes; notification to patients of the pharmacy closing at least 30 days prior to the date of closing and addressing direct communication to patients and the posting of signs or other public notices; notification to the pharmacist in charge of the receiving pharmacy at least 30 days prior to the pharmacy closing; and requiring cancellation or revocation of all authorizations to utilize the DEA’s online controlled substances ordering system (CSOS) on behalf of the closing pharmacy. The amendment also requires that the closing pharmacy ensure the transfer of all patient records to a pharmacy that is held to the same standards of confidentiality as the closing pharmacy and that agrees to act as custodian for the closing pharmacy’s records for the retention periods required under federal and state laws, rules, and regulations.

Outreach Efforts to Iowa Pharmacists and Technicians--Evening Dinner Meetings. The Board is pleased to announce that it is initiating a new program to reach out to all Iowa pharmacists and technicians. As part of this effort, the Board will be holding a series of meetings across the state during the last half of 2011. The purpose of the meetings is to engage Iowa pharmacists and technicians in meaningful dialogue to learn what their concerns are and what they need help with. The Board will also use these meetings as an opportunity to educate pharmacists and technicians about changes in laws and rules, as well as issues that the Board is dealing with. Meetings will be held from 6 p.m. to 9 p.m., beginning with dinner and ending with a "town-hall" type meeting. The meetings will focus on and encourage audience participation. Meetings will be held as follows:

Tuesday evening, September 13, 2011, Des Moines--Blank Park Zoo
Thursday evening, October 13, 2011, in Council Bluffs
Thursday evening, November 10, 2011, in Iowa City

The Council Bluffs and Iowa City venues have not yet been selected. There will be no registration fee. However, reservations are required and attendees need to register at least two weeks prior to the meeting. Any pharmacist or technician who wishes to attend one of the meetings should RSVP to rebecca.hall@iowa.gov. E-mails should include the attendee's full name and address, indicate whether the attendee is a pharmacist or a technician, and indicate which meeting he or she wishes to attend. Chapter 11, "Drugs in Emergency Medical Service"

Pursuant to the authority of Iowa Code section 124.301 and 147.76, the Board of Pharmacy terminates the rule making initiated by its Notice of Intended Action published in the Iowa Administrative Bulletin on June 30, 2010, as ARC 8923B. The Notice proposed to rescind Chapter 11, "Drugs in Emergency Medical Service Programs," Iowa Administrative Code, and to adopt new Chapter 11 with the same time.

The Board is now filing a new Notice proposint to rescind Chapter 11 and to adopt new Chapter 11, "Drugs in Emergency MedicalServices Programs."

The amendment was aproved at the March 8, 2011, regular meeting of the Board of Pharmcy.

The following rule amendments were approved and adopted during the March 8, 2011, meeting of the Iowa Board of Pharmacy. They become effective June 22, 2011.

Chapter 3, "Pharmacy Technicians." The amendment identifies the technical functions that may be delegated by a supervising pharmacist to a pharmacy technician trainee or an uncertified pharmacy technician and clarifies that the functions that are identified in Chapter 5 that may be delegated to a pharmacy support person may also be delegated to a pharmacy technician.

The following rule amendments were approved and adopted during he April 26, 2011, meeting of the Iowa Board of Pharmacy. They become effective July 6, 2011.

Chapter 8, "Universal Practice Standards." The amendments add pharmacy technicians, pharmacy support persons, and pharmacist-interns to those regulated individuals subject to activities identified as unethical conduct and prohibit any purchasing pharmacy or pharmacist from engaging in any activity or agreeing to any provision in a transaction for the sale or transfer of prescription records that would prevent or prohibit prior patient notification of a pending transfer of the patient’s records. New paragraph 8.16(3)“e” provides that a closing pharmacy may transfer prescription and patient records to a pharmacy that agrees to act as the custodian of the transferred records and that is held to the same confidentiality standards as the originating pharmacy. Amendments to subrule 8.35(6) add catchwords to identify the paragraphs and clarify the applicable rule provisions in the event of a change of owner of a pharmacy.

The following rule amendments were approved and adopted during the January 11, 2011, meeting of the Iowa Board of Pharmacy. They became effective April 13, 2011.

Chapter 2, "Pharmacist Licenses." The amendment provides for an exemption from pharmacist continuing education requirements during any period in which a pharmacist is participating in a pharmacy residency program and requires that a pharmacist wishing such exemption petition the Board as soon as possible following commencement of the residency program and prior to completion of the program.
Chapter 3, "Pharmacy Technicians." The amendments clarify that a certified pharmacy technician must maintain both the Iowa registration and the national technician certification in good standing in order to practice as a certified pharmacy technician in Iowa.
Chapter 7, "Hospital Pharmacy Practice." The amendments clarify the record requirements for identifying a pharmacist who is involved in the visual verification of a drug product or device that has been remotely verified and approved for dispensing when a hospital pharmacy is closed. The amendments further clarify that only a certified pharmacy technician may assist non-pharmacy personnel to locate a needed prescription drug when the pharmacy is closed and when the pharmacist in charge has so authorized the certified pharmacy technician.
Chapter 8, "Universal Practice Standards." The amendment requires that a log of the initials or unique identification codes identifying by name each pharmacy support person, in addition to pharmacists, pharmacist-interns, and pharmacy technicians, shall be maintained by the pharmacy and be available for inspection or copying for a minimum two years.
Chapter 10, "Controlled Substances." The amendment clarifies the requirement for reducing an oral prescription to a written format, providing that the written format may be a computer-generated print of the information required for the prescription and is not limited to a handwritten format.
Chapter 13, "Sterile Compounding Practices." The amendment provides for an exception for the placement of a compounding aseptic isolator (CAI) within an ISO Class 8 anteroom or ante area when the CAI meets ISO Class 5 atmospheric environment conditions.
Chapter 35, "Contested Cases," and Chapter 36, "Discipline." The amendments correct the name of the Board by deleting the term “Examiners” and correct the title of the executive director, formerly the executive secretary/director. The proposed amendments also eliminate an invalid Iowa Code reference in Item 20. Proposed amendments in Items 4, 11, 18, and 23 clarify the process for delivery of various documents and communications relating to contested cases and disciplinary actions.
